(a) Every person granted a permit to construct a sidewalk crossing shall pave and maintain the sidewalk, where crossed, at such person's expense, with materials as the Director of Public Works may designate and in such manner as the Director may prescribe. However, if concrete sidewalk exists for single-family residential use and a comprehensive program for sidewalk repair or replacement is being performed by or for the City, the landowner shall not be assessed the cost of repairing or replacing the portion of the sidewalk through the landowner's driveway. (b) The owner of any premises abutting that portion of public street right-of-way, whether in front or to any side, to which any form of sidewalk crossing may exist shall be the prima facie owner and responsible party for the maintenance of the sidewalk crossing, whether permitted or not, and adjacent section of sidewalk pavement thereof and shall indemnify and hold the City harmless for any claim or litigation that may ensue as a result from the existence and operation of the sidewalk crossing.
