- Staff · February 22, 2021The complaint does not involve any public right of way drainage or displacement of such on the property. This issue really is a civil matter for the two property owners to address if any actions are taken at all. The image below illustrates a brief rendering of the two properties and the elevations of the lots/parcel. The Commercial property (Tuffy’s Muffler) rear property is approximately 1-3 ft higher than the property of the Melson’s property of 2521 Bells road. Based on the land topography it’s expected that runoff and sheet flows would drain to lower portions of the property and along the property lines of Melson’s property. There are no violations here which would require City involvement. The commercial property has not changed anything nor are they directing any flows to the property. The lay of the land is dictating what happens here. This is not a City issue as this is all private property.
